These Terms & Conditions govern your use of our website and the purchase of goods from us. By placing an order, you agree to be bound by these terms.

Alchemy Ferns is a UK-based retail nursery located in York, specialising in hardy ferns and tree ferns.
References to “we”, “us” and “our” refer to Alchemy Ferns.
References to “you” refer to the customer or website user.

All website content including text, images, layout and design is the property of Alchemy Ferns and may not be reproduced without permission.
Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

We make every effort to ensure product descriptions and images are accurate. However:
- Plants are natural living products and may vary in size, shape and appearance.

- Measurements are approximate.

4. Pricing
All prices are listed in GBP (£).
We reserve the right to change prices at any time.
The price you pay is the price displayed at the time of ordering.
If an obvious pricing error occurs, we reserve the right to cancel the order and refund any payment made.
5. Orders
When you place an order, you will receive an email confirmation. This does not constitute acceptance of your order.
A contract is formed when we dispatch your goods.
We reserve the right to refuse or cancel any order at our discretion.
6. Payment
Payments are processed securely via third-party providers (such as Stripe, PayPal or Braintree). We do not store full payment card details.
Orders will not be dispatched until payment has been received in full.
7. Delivery
Delivery charges and options are displayed at checkout.
We aim to dispatch orders within the timeframe stated on our Delivery Information page. However, delivery times are estimates and not guaranteed.
We are not liable for delays caused by courier services or circumstances beyond our control.
Risk in the goods passes to you upon delivery.
8. Collection
Collection from the nursery is by prior appointment only.
9. Cancellations (Consumer Contracts Regulations)
Under UK law, you have the right to cancel your order within 14 days of receiving the goods.
However, this right does not apply to:
- Perishable goods
- Plants that have been planted or altered
- Custom or made-to-order items
To exercise your right to cancel, you must notify us in writing within 14 days.
Returned items must be in their original condition. You are responsible for return postage costs unless the item is faulty.
10. Damaged or Faulty Goods
If goods arrive damaged, you must notify us within 48 hours of delivery and provide photographic evidence.
We may offer a replacement or refund at our discretion.
11. Plant Health
All plants are supplied in compliance with UK plant health regulations and issued with the appropriate Plant Passport where required.
Once planted or exposed to unsuitable conditions, we cannot accept responsibility for plant performance.
12. Limitation of Liability
To the fullest extent permitted by law, Alchemy Ferns shall not be liable for:
- Indirect or consequential losses
- Loss of profits
- Delays beyond our reasonable control
Nothing in these terms excludes liability for death or personal injury caused by negligence or fraud.
